Based on the provisions of Article 3 (Paragraph 16) of the Geologists Syndicate Law No. 197 of 1968, and based on the Geologists Syndicate Council Resolution No. 46 taken at its session dated 30-8-1970, we have issued the following instructions:<\/p>

Article 1:<\/h3>

A consulting office shall be established by two or more members of the Syndicate for the purpose of conducting business and consulting, with a specific specialization, in accordance with the following conditions:
A – At least two of the office founders must meet the following conditions:
1 – At least eight years of service.
2 – The period of study required to obtain a higher degree shall be considered in calculating the period for paragraph 1 according to the internal regulations of the Geologists Syndicate.
B- The founders shall submit a signed application to the Syndicate pursuant to the consulting office establishment form prepared by the Syndicate, including all required information.
C- The Syndicate Council shall decide whether to accept or reject the application within a period of (60) days from the date of submission of the application, which includes all required data and documents. Otherwise, from the date of its completion, the Syndicate shall notify the founders of the decision, and a certificate of establishment of the consulting office shall be issued based on it. If no decision is issued within the aforementioned period, the application shall be deemed accepted upon expiration of the period.<\/p>

Article 2:<\/h3>

A consulting office may not engage in activities unless the Syndicate approves its registration, or the period of (60) days from the date of submission of the application or completion of the documents expires without a decision from the Syndicate.<\/p>

Article 3:<\/h3>

Foreign geological and engineering consulting offices established outside Iraq and without branches therein may submit their bids in Iraq. No work may be assigned to them after the issuance of these instructions except in accordance with the following conditions:
The foreign office must organize a professional cooperation agreement with an Iraqi geological consulting office pursuant to a partnership agreement for this purpose, a copy of which must be deposited with the Syndicate. This agreement must include the full joint exercise of the responsibilities of the partnership, and the Iraqi office’s participation in the exercise of the responsibilities must not be less than 20 percent.
General Provisions<\/p>

Article 4:<\/h3>

A. After completing the procedures for establishing the office pursuant to these instructions, the Syndicate shall register it in the list of consulting offices operating in Iraq.
B. 1. The registration fee and annual subscription for the office and branch shall be 30 dinars for each calendar year, paid to the Syndicate. When the office is registered during the year, it shall be charged for the remaining period of the year, unless the remaining period is less than six months, in which case half the fee shall be collected.
2- The founders shall pay the fee upon being notified of the Syndicate’s decision to accept the application to establish the office, or upon the expiration of the 60-day period without a decision being issued. A certificate of incorporation shall not be issued, and the office shall not be included in the office register unless the fee is paid.
3- The fee shall be paid annually during the first three months of the year. If the office is late in doing so, the Syndicate Council may prevent it from carrying out its work and may also promote its registration in the register. In this case, the office may not carry out its work unless it submits a new application to establish it in accordance with these instructions, except one year after the date of its promotion.
C- The consulting office or branch is obligated to comply with the provisions of the law and the internal regulations of the Geologists Syndicate in the Republic of Iraq. Violation of these provisions and the provisions of these instructions shall subject the founder to disciplinary action, in addition to subjecting the office to suspension from work, cancellation of its license, and promotion of its registration.
D- These instructions shall not apply to projects referred and whose contracts were signed prior to the issuance of these instructions. E- The term “office” wherever it appears in this Article (Fourth) includes the Iraqi or foreign geological consulting office.<\/p>

Article 5:<\/h3>

Consulting offices must abide by the contents of the contract regulated by the Syndicate and may not violate its provisions except with the Syndicate’s approval.<\/p>

Article 6:<\/h3>

A member may not participate in the establishment of a consulting office or represent a branch of more than one office.<\/p>

Article 7:<\/h3>

A consultant may not undertake any work until after establishing a consulting office.
Article 8:
Agreements concluded by the government with government consulting institutions are exempt from the terms of these instructions.<\/p>

Article 9:<\/h3>

These instructions shall be implemented from the date of their publication in the Official Gazette.
